The procedure for reimbursement of state or local budget funds spent on training services

About the statement of the Procedure of reimbursement of the state or local budget funds spent on training servsces.

In accordance with the first part of Article 4 of the Law of Ukraine “On Higher Education”, the Cabinet of Ministers of Ukraine resolves:

To approve the Procedure for reimbursement of the state or local budget funds spent on training services, attached.

The Procedure
of reimbursement of state or local budget funds spent on training services

1. This Procedure determines the procedure for reimbursement to the state or local budget of funds spent on training services for specialists from among citizens of Ukraine who studied at the state order in higher education institutions, have not completed education at a certain level of education and wish to re-obtain higher education in state or municipal higher education institutions at the same level of education by state order (hereinafter – funds).
2. This Procedure shall apply to persons who are specified in paragraph 1 of this Procedure and starting from September 1, 2015 will re-obtain higher education by state order in state or municipal higher education institutions.
3. If the results of entrance examinations in accordance with the legislation provide grounds for enrollment of a person for re-acquisition of higher education at a certain degree by state order, the head of the relevant higher education institution shall issue an order for enrollment in the number of applicants for higher education and sets the deadline for reimbursement of such person no later than 10 working days from the date of the relevant academic year.
4. The higher education institution to which a person is enrolled may, at his / her request, credit credits of the European Credit Transfer and Accumulation System, for which he / she is certified at the previous place of study, including disciplines freely chosen by the person on the basis of an academic certificate order at the previous place of study.
5. The calculation of funds to be reimbursed is carried out according to the following formula:

where S – funds to be reimbursed by the relevant person;

n – the number of semesters after which the person is certified at the previous place of study;

30 – standard of the number of credits of the European credit transfer-accumulative system for one academic semester;

Vi – the actual average cost of training at the expense of the general fund of the state or the corresponding local budget of one resulted

Vi – the actual average cost of education at the expense of the general fund of the state or relevant local budget of one student for the i-th year according to the report on financial and economic activities of higher education institution where the person first received higher education by state order (respectively Vi x 0, 5 – the actual average cost of training during one semester);

K – the total number of loans of the European Credit Transfer and Accumulation System, for which the person is certified at the previous place of study;

Kz is the total number of credits of the European Credit Transfer and Accumulation System, for which the person is certified at the previous place of study and which are credited by the higher education institution at the new place of study.

6. Based on the calculation of costs associated with obtaining higher education based on the actual average cost of education at the expense of the general fund of the state or relevant local budget of one student for the i-th year according to the report on financial and economic activities of higher education where a person has obtained higher education for the first time by state order, such educational institution within three working days from the date of application is obliged to provide a certificate signed by the head and the chief accountant of the educational institution indicating the actual average cost of education at the expense of the state or local budget of one given student in such an educational institution in terms of academic semesters.

Based on the calculation made in accordance with paragraph 5 of this Procedure, the higher education institution to which the person is enrolled for re-education by state order, not later than three working days from the date of submission of the certificate specified in the first paragraph of this article, provides a settlement document to reimburse funds. In this case, the amount of funds to be reimbursed is increased by a coefficient equal to the product of officially established inflation rates for the relevant calendar year, which is determined for the period from the date of expulsion from higher education to January 1 of the year in which the person is enrolled for re-acquisition of higher education by state order.

The person reimburses the funds through the higher education institution to which he is enrolled for re-acquisition of higher education by state order, to a separate special registration account opened by the Treasury to the chief administrator of funds, which manages the higher education institution, for further crediting to the state or the relevant local budget.

7. The head of the educational institution to which the person is enrolled for re-acquisition of higher education by state order, may independently restructure the reimbursement and set a deadline for their reimbursement during the current academic year on a reasoned application of the person taking into account his financial situation. The first payment must be at least 50 percent of the total amount to be reimbursed.
8. A document confirming full or partial reimbursement to the state or relevant local budget in the prescribed amount shall be submitted to the higher education institution to which the person is enrolled for re-acquisition of higher education by state order, not later than 10 working days from the date of payment.

A person who has not submitted the specified document shall be subject to immediate expulsion from the higher educational institution.

In case of refusal of voluntary reimbursement of restructured payments, the person is immediately expelled from the higher education institution, and the issue of reimbursement is resolved in court.

9. Clarification on the application of this Procedure shall be provided by the Ministry of Education and Science.
